REGULATION ON ESTABLISHMENT, DUTY, AND OPERATIONAL PROCEDURES AND PRINCIPLES 

SECTION ONE
Aim, Scope, Basis and Definitions

Aim
Article 1–
This regulation aims to specify the rules on establishment, duty, and operational procedures and principles of the Education Commission to be established by the Board of Directors within the framework of Article 34 of the Charter.

Scope
Article 2-
This regulation includes the rules to be based on establishment of Education Commission, the duty and functions of the Commission, and operational procedures and principles thereof.
 
Basis
Article 3-
The basis of this Regulation is Articles 34, 40 and 56 of the Charter.

Definitions
Article 4 –
The following terms in this Regulation shall have the following meanings:

Darüşşafaka means Darüşşafaka Society;
Charter means the Charter of Darüşşafaka Society;
Board of Directors means the Board of Directors of Darüşşafaka Society;
Chairman of the Board of Directors means the Chairman of the Board of Directors of Darüşşafaka Society;
Education Institutions means Darüşşafaka Education Institutions;
Commission means the Education Commission of Darüşşafaka Society;
Student Selection, Registry and Admission Commission means the Student Selection, Registry and Admission Commission of Darüşşafaka Education Institutions; 
Secretariat General means the Secretariat General of Darüşşafaka Society;
Secretary General means the Secretary General of Darüşşafaka Society;
Director General means the Director General of Darüşşafaka Education Institutions;
 
SECTION TWO
Aim and Function
– Authority and Duties of the Commission

Aim and Function of the Commission
Article 5-
The function and aim of the Education Commission established within the framework of Article 34 and Article 45 of the Charter can be listed as follows: (i) to obtain information on educational activities of school units by contacting Education Institutions’ Director General/ Elementary, Secondary and High School Principals according to of the Charter; (ii) to specify observations and recommendations; and (iii) to contribute to continuation of educational activities of Education Institutions, which are in compliance with the mission of Darüşşafaka, absorbing all kinds of social and technological development as necessary in this era and a well-equipped, qualified and high level in the academic field, by submitting results and recommendations for all of these purposes to the Board of Directors. 

Authority and Duties of the Commission 
Article 6-
The authorities and duties of the Commission is to inform the Board of Directors about the results and offers in the stage of preparedness to execution in line with the information obtained and observations made and recommendations specified within the framework of the function and aim stated in Article 5 of this Regulation. 

In this context, the Commission;

6.01- examines whether Strategic Plan and Annual Working Schedule, drawn up by the Educational Institutions’ Director General/ Elementary, Secondary and High School Principals, complies with the vision and mission of the Educational Institutions and submits it to approval of the Board of Directors by assuring its conformity.
 
6.02- examines whether activities and expenses within the year complies with Education Institutions’ Budget and Annual Working Schedule, drawn up and submitted by the Educational Institutions’ Director General/ Elementary, Secondary and High School Principals, and submits its results and recommendations to the approval of the Board of Directors.
 
6.03- examines, monthly and periodically (mid-term and year-end), the working schedules of the Education Institutions as well as performance and development of the tutors and students in line with the objectives, and submits its assessments, opinions and recommendations to the Board of Directors for all these purposes. 
 
6.04- makes pre-assessment of the briefing including assessments, opinions and recommendations tat are at least quarterly submitted to the Board of Directors on current status by the Educational Institutions’ Director General/ Elementary, Secondary and High School Principals.
 
6.05- submits its opinions and recommendations on modifications that are necessary in Regulations on Education Institutions to the Board of Directors. 
 
6.06- examines and assesses the evaluation criteria of Darüşşafaka Admission Examination that are given on the students who are admissible to the 4th and 5th grades by the Administrative Committee of the School Management together with the Student Selection, Registry and Admission Commission. The Commission submits its recommendations to the Board of Directors on students admissible for school’s primary and reserve placements drawn up by the Commission together with the Student Selection, Registry and Admission Commission.

6.07- submits to the Board of Directors the report on establishment and employment of the academic personnel and evaluations about the tutors that are required to be dismissed according to performance assessments by taking into account the recommendations of the Educational Institutions’ Director General/ Elementary, Secondary and High School Principals.

In addition, the Commission makes recommendations to the Board of Directors on the decisions to be taken with regard to the Educational Institutions’ Director General/ Elementary, Secondary and High School Principals.

6.08- sends a copy of the minutes of the Commission’s meeting to the Board of Directors for information and to the Secretariat General for information, record and further action. 

The presentations and evaluations, which will be made by the Commission to the Board of Directors, shall be notified to the Chairman of the Board of Directors at least five days prior to the date of the meeting of the Board of Directors by the Educational Institutions’ Director General/ Elementary, Secondary and High School Principals if found to be suitable by the Head of the Commission of the Commission. 

6.09- Any member of the Commission may request from the Board of Directors to make a decision on evaluations or recommendations if it identifies any changes or developments that may considerably influence the general content, properties and quality of education in the Education Institutions that are foreseen in this Regulation. 

In such a case, evaluations and recommendations of the member of the Commission is put on the agenda of the meeting of the Board of Directors provided that it is notified, in writing, to the Chairman of the Board of Directors at least five days prior to the date of the meeting of the Board of Directors. 

SECTION THREE
Establishment and Operational Principles of the Commission

Establishment of the Commission
Article 7-
The head of the commission, composed of seven people, is elected among deputy chairmen of the Board of Directors and the other members are elected among the members of the Society, of which three members should be members of the Board of Directors. 

The Board of Directors elects the Head and the Members of the Commission according to Article 34 of the Charter. 
Education Institutions’ Director General / Elementary, Secondary and High School Principals attend the meetings of the Commission. 

The Chairman of the Board of Directors may attend the meeting of the Commission if he/she finds it necessary. The Secretary General may also attend the meeting of the Commission if it is necessary in terms of the Commission’s agenda.

Article 8- The services of the members of the Commission are provided voluntarily, and the term of the membership is specified by the Board of Directors.

Operational Principles of the Commission
Article 9-
The Commission meets at least two times in a month. 

The Chairman of the Board of Directors may call Commission for a meeting ex officio in terms of a special agenda, when necessary. 

The quorum of the Commission for debate is at least four and the decisions are made by majority of votes.

In the case of a tie vote, the vote of the head of the Commission shall prevail.

The decisions taken at the meeting are recorded in the minute book of the Commission. 

The Head of the Commission ensures that minutes of the meeting are regularly kept by the secretariat for the purpose of providing comprehensive information on the assessments made in the meetings of the Board of Directors. The minutes of the meeting and final opinions are submitted to the Board of Directors after being approved by all members of the Commission. 

Article 10- The secretariat of the Board of Directors executes the Commission’s secretariat. At least three days before the meeting, the agenda of the meeting, drawn up by the Head of the Commission are delivered to the members of the Commission by secretariat. The secretariat of the Board of Directors is responsible for regularly keeping minutes of the meeting and final decisions, delivering them to the Board of Directors and keeping the minute book. 

SECTION FOUR
Final Provisions 

Provisions that are not stipulated in the Regulation
Article 11-
The Board of Directors is the authorized decision-making body for circumstances that are not stipulated in this Regulation. 
 
Enforcement
Article 12-
The modifications that are made with regard to the Regulation on Education Commission, acknowledged upon the decision of the Board of Directors dated 04.11.2008 and numbered 44, have been acknowledged upon the decision of the Board of Directors dated 16.10.2012 and numbered 58.
